Judge orders residents and city to come to agreement on partially collapsed building in Buffalo, New York

Buffalo, New York —Judge Justice Christopher Burns of the New York State Supreme Court has ordered a halt to an emergency demolition on a 19th century stable and livery on 428-430 Jersey Street in Buffalo, New York that partially collapsed on Wednesday June 11, initially causing at least 15 homes to be evacuated. At least two homes remain evacuated.

Burns orders that both the city and the group Save The Livery (www.savethelivery.com) have to come to an agreement on what to do with the building, and try to work out ways of saving at least some portions if it including the facade, side walls and a lift tower. Save The Livery is comprised of concerned area residents who have grown to love the building’s historic and unique character. On June 14, they won a temporary restraining order to stop demolition. The court ruled that the city was only allowed to remove material in immediate danger to residents and pedestrians, but stated that the demolition could only be performed with “hand tools.” The court also ordered that any rubble which had fallen into neighboring yards when the building collapsed, to be removed.

“It is in the interest of the city to have a safe environment–but also important to maintain a sense of historical preservation,” stated Burns in his ruling. Burns has given the sides until tomorrow (Friday June 20) to come to an agreement and has ordered both parties to return to court at 9:30 a.m. (eastern time) “sharp.” Activists of Save The Livery urge supporters of the stable to “fill the courtroom” to show “continued and ongoing support.” The hearing is scheduled to take place at 25 Delaware Avenue in the Supreme Court building, 3rd Floor, trial part 19.

Currently the building is owned by Bob Freudenheim who has several building violations against him because of the buildings poor condition. He has received at least five violations in three months and residents who live near the building state that Freudenheim should be “100% responsible” for his actions. Many are afraid that if the building is demolished, Freudenheim’s charges of neglect will be abolished.

On June 17, developer and CEO of Savarino Companies, Sam Savarino was at the site of the stable, discussing the building with residents and preservationists. In 2006, Savarino proposed and planned The Elmwood Village Hotel, a ‘botique’ hotel on the Southeast corner of Elmwood and Forest Avenues. The project was later withdrawn after residents filed a lawsuit against Savarino and the city. Wikinews extensively covered the story, and contacted Savarino for his professional opinion on the building.

“[I would] love to see it preserved. I was there to see if there was anything we could do to help, to see if anything can be salvaged. I just want to see the right thing happen, and so does the city,” stated Savarino to Wikinews who added that he was allowed inside the building for a brief period.

“The side walls are beyond repair. The roof has rotted and it could come down at any time,” added Savarino who also said that the building “below the second floor appears to be stable.” He also states that the back wall of the building, which borders several homes, appears to be intact.

“Eliminating the back wall could be a problem for the neighbors. It is not unreasonable to leave at least 12 feet” of the back wall standing, added Savarino.

Savarino did not say if he was interested in buying the property, but did state, “I am sure there are a couple of people interested” in buying the property. On Thursday, Buffalo News reported that a “businessman” might be interested in purchasing the property, though Wikinews is not able to independently confirm the report. Savarino says that with the property still slated for emergency demolition, a potential buyer could face tax fees of nearly US$300,000.

Freudenheim gave the city permission to demolish the building on Thursday June 12 during an emergency Preservation Board meeting, because he would not be “rehabilitating the building anytime soon.” Freudenheim, along with his wife Nina, were part-owners of the Hotel Lenox at 140 North Street in Buffalo and were advocates to stop the Elmwood Village Hotel. They also financially supported a lawsuit in an attempt to stop the hotel from being built. Though it is not known exactly how long Freudenheim has owned the stable, Wikinews has learned that he was the owner while fighting to stop the hotel from being built. Residents say that he has been the owner for at least 22 years.

The building was first owned by a company called White Bros. and was used as a stable for a farm which once covered the land around the building for several blocks. The Buffalo Fire Department believes the building was built around 1814, while the city property database states it was built in 1870. Servants and workers of the farm were housed inside resident quarters situated at the rear of the building on what is now Summer Street, but are now cottages where area residents currently reside. Some date as far back as 1829.

At about 1950, the stable was converted into an automobile body shop and gasoline station.A property record search showed that in 1950 at least four fuel storage tanks were installed on the property. Two are listed as 550 square feet while the other two are 2,000 square feet. All of the tanks are designated as a TK4, which New York State says is used for “below ground horizontal bulk fuel storage.” The cost of installing a tank of that nature according to the state, at that time, included the tank itself, “excavation and backfill,” but did not include “the piping, ballast, or hold-down slab orring.” It is not known if the tanks are still on the property, but residents are concerned the city was not taking the precautions to find out.

Dubai World to receive $9.5 billion in government aid

The government of Dubai announced that it intends to provide $9.5 billion to Dubai World to allow the government-owned investment company to restructure its debt.

The announcement comes as part of Dubai World’s plan to restructure more than $23 billion of debt, including converting nearly $9 billion of debt into equity, after its collapse last fall. The package includes $8 billion of funding to Nakheel, Dubai World’s real estate subsidiary, as well as $1.5 billion to Dubai World as a whole. The restructuring plan also seeks to, within eight years, repay all of Dubai World’s creditors.

According to the government of Dubai, $5.7 billion of the aid was from a former $10 billion loan to Dubai World, with the remainder being internally funded. The plan would transfer ownership of Nakheel, formerly a subsidiary of Dubai World, to the direct control of the Dubai government.

Response to the deal was largely positive, with one analyst saying the move “boosts sentiment because this is a strong commitment.” Christopher Davidson, author of books on Dubai and Abu Dhabi, said that while the new funding would “keep the wolves outside the gates a little longer,” the government could not be the sole funder of Dubai World and Nakheel.

Ontario church holds large service defying province guidelines

The Church of God in Aylmer, Ontario, Canada held an large in-person church service on Sunday, defying Ontario’s new COVID-19 guidelines, which limits religious services must be kept below 10 people. The service was live-streamed, and over 100 people gathered indoors without wearing masks or social distancing. There were about 200 cars in the parking lot. Attendees included Member of Provincial Parliament Randy Hillier and member of parliament Derek Sloan. Aylmer police say they are investigating this and charges will be made. On Tuesday, four people were charged after another gathering at the same church, and 18 were found to not be following COVID-19 guidelines.

Pastor Henry Hildebrandt addressed churchgoers by thanking COVID-19 in a YouTube video posted by the Church of God. “There is no foundation on which we can build than Jesus Christ, our rock, our Lord and our saviour. God bless you and God bless Canada,” Sloan said. “It brings tears to my eyes to see so many people here,” Hillier said. Hildebrandt continued the service for more than an hour, and spoke to other pastors. While the service was happening, police were outside monitoring and collecting vehicle information.

Afghan president Hamid Karzai opens new terminal at Kabul International Airport

Hamid Karzai, president of Afghanistan, has opened a new terminal at Kabul International Airport. The US$35m (£22m) two-story structure was gifted by Japan as the old terminal building had become badly damaged by decades of war.

Speaking at the event, attended by 150 Afghan and Japanese officials, Karzai expressed his gratitude for the building, saying “Afghanistan could not have made this terminal on its own for many years or without lots of effort.” The new terminal is built next to the original sixties building, which had been considered luxurious when new but has fallen into decline, especially after the 1979 Soviet invasion and the civil war which followed.

Increasing numbers of military aircraft joined the commercial passenger planes, making Kabul International a frequent target of rocket attacks. It was in a poor state of repair, as well as outdated and in need of expansion, by the time the Taliban were ousted from Afghanistan.

Karzai implored his people to take proper care of the new terminal, which Afghan officials described as a step along the route to reconstruction after the Taliban were deposed.

“I hope, now this facility has been handed over to us, that our sisters and brothers, those in charge of the airport, the passengers passing through, the state officials and MPs using it, will look after it and they should not allow, God forbid, that we come here after a year and find its windows, doors and tiles broken,” he said.

The building will enter service next week, in time to carry passengers to Saudi Arabia for the annual pilgrimage of the Hajj. It has a capacity of one million passengers every year, and will service both domestic and international routes.

In an attempt to speak with as many candidates as possible during the 2008 Canadian federal election, Wikinews has talked via email with David Sparrow. Sparrow is a candidate in Ontario’s Don Valley West riding, running under the New Democratic Party (NDP) banner. The riding was set to vote in a by-election on September 22, 2008, following the resignation of John Godfrey, but Stephen Harper’s sudden election call nulled that effort.

Also running in the Toronto riding are Liberal Rob Oliphant, Conservative John Carmichael, Green Georgina Wilcock, and Communist Catherine Holliday.

Kiribati acquires international funding for solar power

Last Tuesday, AusAID Australia and the World Bank’s Global Environment Fund (GEF) reached an agreement to give the government of Kiribati US$5 million (AU$4,779,000, NZ$5,985,000, €3,885,000) to install solar panels around the country capital, located on the Tarawa atoll. According to Business Desk of the Brunei Times, AusAID promised AU$3.2 million in funding, while GEF promised US$1 million. The country was the first in the Pacific to make a deal with the World Bank.

The funding was part of a US$530 million (NZ$635 million) package announced at yesterday’s Pacific Energy Summit in Auckland involving New Zealand and the European Union, Australia, the Asian Development Bank, the European Investment Bank, the Japan International Cooperation Agency, the World Bank Group, and the United Arab Emirates. Also at the summit yesterday, New Zealand’s Foreign Affairs Minister Murray McCully had announced a national commitment of USD$54,262,000 (AU$51,861,000 NZ$65 million, €42,178,000) to Pacific region energy solutions, of which US$8,348,000 (AU$8 million, NZ$10 million, €6,483,000) would be specifically earmarked for renewable energy and improved energy efficiency in the Cook Islands, Kiribati, Papua New Guinea, Samoa, Tonga, and Tuvalu.

Kiribati is heavily dependent on diesel fuel for most of the energy available on the national power grid, which supplies power to half Kiribati’s population of 110,000. In addition, a third of the country’s population lacks access to electricity. Once installation of the solar panels is complete, they are estimated to reduce diesel consumption by 230,000 liters (60,760 gallons) a year and give access to the electricity to some parts of the population that currently have no electricity. The European Union already has committed €100 million to sustainable energy in the region, with €10 million of that coming as a result of an announcement made last week.

In a press release about the news, Kiribati President Anote Tong was quoted as saying, “Kiribati faces big challenges it is remote, it is at risk from the effects of climate change, and it is vulnerable to economic shocks. […] Shifting Kiribati’s focus to reliable solar energy will provide a more secure, more sustainable power source for the country’s people.” Radio New Zealand International quoted Tong as saying, “It’s the first time we are doing this. We’re excited at the prospect of even substituting fossil fuel to a small extent at this stage. What the system being envisaged will only produce around 500 kilowatts, but this is the beginning of what I hope will be a pattern, the trend in the future.”

The European Union’s Fiji-based head of operations for the Pacific region, Renato Mele, supported alternative energy solutions like solar power for the region, but said that solar power had limitations because climate and environmental conditions sometimes meant batteries required to power the panels had a life of only 12 months, compared to other climates where batteries normally last five years. This created the potential to drive up standard operating costs. Mele has also noted these additional costs though are still lower than the cost of diesel power.

One News Pacific Correspondent Barbara Dreaver noted, “Governments will be able to put the money they (currently) spend on diesel into things like education and health.”
