Buffalo, New York —Buffalo, New York developers have been stymied by old real estate deeds.

The prospective Elmwood Village Hotel may be scuttled and businesses now located there may be forced to move.

Frustrations over property located in an area once known as “Granger Estates” circulate around a clause in the original deeds over land divided by then-owner Erastus Granger in the early 1800’s.

According to the documents, “no business establishment of any kind whatsoever” shall ever be constructed on the property, and they shall forever be exclusively for residential use only. Also prohibited are barns, farms and stables.

Sam Savarino, CEO of Savarino Companies, the prospective hotel developer, announced that his legal research team found the restrictions on properties located between 1109 and 1121 Elmwood Avenue which also stated in part that “no businesses, hospitality establishment of anykind whatsoever” shall ever be permitted to be built on the property.

Savarino, whom is expected to contest the restrictions, said that his company could have ignored the findings, but that, “we can’t risk the future of a multimillion-dollar project on the hope they wouldn’t be discovered. Our opponents would have had a field day if they’d surfaced after the fact.”

Savarino said his attorneys and researchers are anticipated to determine “exactly what weight the restrictions carry and if there’s a way for the courts to negate them.”

Existing businesses are also jeopardized.

Hans Mobius, owner of some of the restricted properties upon which a carriage house is built, said, he wasn’t aware of any restrictions, and “never had a reason to research the deed and title documents.” He confidently added that, “the lawyers can get this taken care of.”

Other threatened businesses include Don Apparel, H.O.D. Tattoo, Forest Plaza Art Gallery and Allentown Music.

FCC extends 911 deadline for VoIP

The US Federal Communications Commission has extended the deadline for Enhanced 911 compliance by VoIP| (Voice over Internet Protocol) providers until Oct 31, 2005. Last May, the FCC issued an order requiring VoIP providers to implement E911 within 120 days. This order also required providers to notify customers of the 911 limitations. Customers who did not acknowledge these limitations would have their services terminated.

This extension gives providers extra time to connect the networks to 911 services, and warn users of the limitations. If the FCC had not granted this extension, at least 10,000 users would have been disconnected.

According to the FCC at least 21 VoIP providers have received an acknowledgment from all customers of the 911 limitations. 32 additional VoIP providers have received an acknowledgment from 90 percent or more of their customers. VoIP providers who have not met the 90% goal could face enforcement proceedings starting October 31, 2005.

FCC said in a statement “it is evident that many providers have devoted significant resources to notifying each of their subscribers of the limitations of their 911 service and obtaining acknowledgements from each of their subscribers.”

New ‘clean water’ funding for Djibouti’s drought-stricken rural areas

With the announcement Monday of 2 million in new funding from the European Union (EU), the Republic of Djibouti’s Ministry of Agriculture hopes to provide some relief to an estimated 25,000 rural inhabitants suffering through severe drought conditions. The money, to be channeled through UNICEF for its water and sanitation program, will be used to develop new wells and improve existing ones.

UNICEF is to contribute a further €60,000, as well as technical expertise to the Ministry of Agriculture, who will carry out the bulk of the work.

“The two-year water supply project targeting rural districts is very significant since people living in 45 villages and their 40,000 heads of cattle will have access to clean drinking water,” said Joaquin Gonzalez, EU Representative in Djibouti.

At the same time, the UN aid agency World Food Program (WFP) indicated that it is working with the Ministry of Agriculture and UNICEF to gradually shift Djibouti’s reliance on emergency aid to a Food for Work program, which it hopes will assist nomadic herders in Djibouti with long-term sustainability. “What we are trying to do together with the Ministry of Agriculture and UNICEF is, for example to dig wells so that despite drought, these herders will be able to irrigate their fields,” said Simon Pluess, WFP spokesman. “And, together with the UN Food and Agriculture Organization, we will try and promote vegetable gardens.”

Djibouti has survived harsh drought conditions for the past 5 years. Groundwater is the primary source of water for drinking and irrigation, but has been difficult to exploit and is often contaminated. Almost 50 percent of people in rural Djibouti do not have ready access to properly developed source of drinking water. And, due to the ongoing drought, water availability for livestock is limited. Livestock have shown signs of distress and, subsequently, milk production is down substantially.

Nearly half of all families in Djibouti’s northwest were forced to migrate to find pasture for their livestock. As the droughts continue, the importance of properly maintained wells has become apparent. “Life is harder and harder for us. Years ago there were more rains and also more pastureland for cattle. Now it is good for us to have functioning wells so that we can keep cattle here,” said Anou Amada, farmer in the village of Andoli.

A 2006 survey indicated that only 15 percent of wells in Djibouti were equipped with a protective concrete wall to prevent contamination. Andoli’s well is one of many undergoing repair through WFP’s Food for Work project.

“WFP couldn’t do this alone, so we work with the Ministry of Agriculture and UNICEF to dig wells and the UN Food and Agriculture Organization for vegetable gardens,” said Benoit Thiry, Director, WFP in Djibouti.

When the project is completed in 2008, it will have increased Djibouti’s water pump capacity by adding 25 solar-power pumps, which would compliment the current 61 diesel-powered pumps. “The advantage of solar…is that it is much cheaper and requires less maintenance,” said Omar Habib, UNICEF communication specialist. “We want the people to participate and to appropriate these pumping stations. The government’s role in the long term should be as restricted as possible,” he added.

Wikileaks cable disclosure shows Arab fears of Iranian ambitions

Sunday night’s release of leaked United States diplomatic cables shows widespread concern in the Arab world over Iran’s ambitions to build a “Persian Empire in the 21st Century”.

Wikileaks, so far, have released under 300 of the quarter million plus diplomatic communications posted to them on a memory stick. The small sample shows, over several months, the United Arab Emirates (UAE), Kuwait and Bahrain asserting that further sanctions against Iran will likely have no effect.

Early November last year, General David Petraeus discussed the situation with King Hamad of Bahrain, who argued for the use of force to thwart Iran’s nuclear ambitions; stating: “The danger of letting it go on is greater than the danger of stopping it.”

In that meeting concern was expressed that more Arab involvement in Iraq was needed to frustrate Iranian plans. Petraeus was told Bahrain sought Egyptians and Saudis support, but talks with the latter revealed no interest in taking a leading rôle.

The King did welcome the prospect of India becoming involved in the region as a stabilising influence.

A mid-December meeting between Crown Prince Mohammed bin Zayed Al Nahyan of the UAE and US Deputy Secretary of Energy Daniel Poneman saw the subject brought up again. In a discussion that touched on the two countries renewable energy plans, and reliable movement of oil through the Strait of Hormuz, the Prince asserted Iran saw itself as spearheading a campaign for a “Persian Empire in the 21st Century.” Alleging Iran has established “emirates” in Kuwait, Bahrain, Eastern Saudi Arabia, Southern Iraq, Yemen, and South Lebanon, his picture of Iranian nuclear ambitions is “Al-Qaeda is not going to get a nuclear bomb; Iran is a matter of time.”File:Iran strait of hormuz 2004.jpg

The Prince was keen to stress that those in power are the same people who, in 1979, seized the US embassy in Tehran.

Subsequent talks between a congressional appropriations sub-committee and UAE’s Foreign Minister were the scene of equally serious predictions. The sub-committee, consisting of Nita Lowey, Tom Cole, Barbara Lee, and Donna Edwards, heard from Sheikh Abdullah bin Zayed Al Nahyan that if Iran became a nuclear state the rest of the region would likely follow suit.

Plans to keep the fifteen-millions-plus barrels of oil passing through the Strait of Hormuz each day moving were discussed. Whilst keen to weaken Iranian ties with China, Sheikh Abdullah stressed the US$50 billion in trade between the two; this being considered an obstacle to China backing, and enforcing, a stronger sanctions regime.

The sub-committee’s Emirates host, like many in the region, stated progress on the Israeli peace process was a good route to de-escalation.

A meeting in February this year with Kuwaiti Interior Minister Jaber Al-Khaled Al Sabah was the scene of comparable warnings. Alongside discussions on travel restrictions to be enforced against former Guantanamo Bay detainees, he described Iran as the “beating heart” of Islamic Extremism.

Concerns over Iran’s involvement in Yemen were discussed, with the minister saying Iran is intent on exporting its revolution; that its nuclear ambitions can only be thwarted by force.

Updating the US on perceived Iranian actions, he claimed they were attempting to infiltrate Egypt by recruiting the poor. And, they were becoming involved in the drugs trade, shipping narcotics into Yemen to fund militants.

A cable originating in London from January this year is corroborated by later U.S. news reports; hinting that the Iranian government may indeed be using tactics more reminiscent of the cold-war.

In the opening weeks of the year, London-based Voice of America commentator Ali Reza Nourizadeh was advised that Mohammed Reza Sadeqinia intended to target him for assassination, along with others. Sadeqinia was previously arrested in California, and prosecuted for attempting to hire a hit man. The target at that time was reported to be Iranian-American broadcaster Jamshid Sharmahd, one of the main figures behind Tondar — a loose collection of in-exile Iranians opposed to the current regime.

Tehran insists Tondar is a terrorist organisation, accusing it of being responsible for a 2008 bombing that killed 14.

Sadeqinia, who worked as a painter in Ann Arbour, was arrested on July 28, 2009 near Los Angeles International Airport in possession of thousands of dollars and an Iranian passport. FBI investigations into his possible Iranian government ties were still ongoing a month before his scheduled release in July this year.

Found guilty by Los Angeles Superior Court of attempting to hire someone to murder Sharmahd, he had been expected to spend around a year in jail. Tondar spokesman Iman Afar, in the lead up to Sedeqina’s release, expressed concern for his own safety and that of others in the L.A. area.

The House session became tumultuous, with the Leader of the House Tony Abbott moving a motion to permit an hour to the consideration in detail stage of the bill, comparing the amount of debate on other bills to this one, stating “we have had very, very extensive debate” and that “members opposite are not interested in debating this bill, they are not interested in trying to improve this bill; they simply want to reject this bill”. The Manager of Opposition Business in the House, Julia Gillard (Abbott’s opposition counterpart), had noted that “more than 20 Labor members are going to be silenced by this motion which is gagging debate”, and when Abbott moved to put the question, “and, here we go, we are going to have a gag on a gag. You’re proud of that, are you? You’re proud of that?”

As Annette Ellis amongst others was one of the aforementioned speakers who had not the time to speak in the debate, she asked whether she could incorporate her speech into Hansard — the Government granted leave for all speakers who intended to speak but could not to incorporate their speeches into Hansard.

In the consideration in detail stage, the Federal Opposition had moved a number of amendments to the legislation, one which would effectively — as Stephen Smith had put it — “kill the bill”, another which would rename the bill to the “Workplace Relations Amendment (Cut Wages, Cut Conditions and Entitlements, No Fairness, No Work Choices) Bill 2005”, but this amendment was ruled out of order by the Speaker of the Australian House of Representatives, David Hawker.

These amendments failed due to the Government majority in the house, and subsequently the bill was successfully read a third time.

One of last night’s surprise wins at the 80th Academy Awards was Glen Hansard and Markéta Irglová winning the Best Original Song Oscar.

The song “Falling Slowly” is from the 2006 film Once, which also co-stars Hansard and Irglová.

The favorite in the category was Enchanted, a Disney film which received nominations for “Happy Working Song“, “That’s How You Know“, and “So Close“. Also nominated was “Raise It Up” from August Rush.

The soundtrack received a Grammy nomination in 2008.

Irglová was cut off by music, when stepping up to the microphone to speak. She was given a second chance to speak after the next commercial break, and was introduced onto the stage by host Jon Stewart.

For some time, the song’s eligibility for an Oscar was in dispute, as it had appeared on a 2006 CD issued by Hansard’s band, The Frames, and it had been performed by the couple in various European venues. The Academy ruled that because the song had been composed for the movie, and the prior public exposure during the long period that the movie took to produce had been minimal, it remained eligible.
