U.S. judge orders release of President Trump’s tax records, appeals court issues delay

On Monday, United States District Court Judge Victor Marrero issued a ruling against President Donald Trump finding that New York City prosecutors could view his tax records after a subpoena issued by a grand jury. The Manhattan district attorney’s office is investigating Trump over alleged hush money paid to two women with whom he has been alleged to have had affairs. Such payments could be considered bribery. President Trump sued Manhattan District Attorney Cyrus R. Vance, Jr. and his own tax preparer Mazars USA to block the release of eight years of tax returns to the grand jury, but Judge Marrero dismissed the president’s lawsuit. The president’s legal team appealed the decision to the Second Circuit Court of Appeals, which issued an administrative stay to Marrero’s order about an hour and a half after the district court ruling.

The appeals court ruling placed a stay on the district court’s ruling until it hears arguments from the president’s lawyers and District Attorney Vance’s office. According to a court clerk, arguments in the case would be scheduled as soon as the week of October 21, with briefs from both parties due in the intervening time until then.

Trump had asked the United States District Court for the Southern District of New York intervene in a New York City criminal proceeding, in which a subpoena had been issued to Trump’s tax preparer. He sought such intervention to prevent Mazars from releasing his tax returns, arguing that, as president, he should be immune from prosecution, and that, by extension, his tax preparer, Mazars USA, could likewise be exempt from investigation. Marrero rejected this argument:

The notion of federal supremacy and presidential immunity from judicial process that the President here invokes, unqualified and boundless in its reach as described above, cuts across the grain of […] constitutional precedents. It also ignores the analytic framework that the Supreme Court has counseled should guide review of presidential claims of immunity from judicial process. Of equal fundamental concern, the President’s claim would tread upon principles of federalism and comity that form essential components of our constitutional structure and the federal/state balance of government powers and functions. Bared to its core, the proposition the President advances reduces to the very notion that the Founders rejected at the inception of the Republic, and that the Supreme Court has since unequivocally repudiated: that a constitutional domain exists in this country in which not only the President, but, derivatively, relatives and persons and business entities associated with him in potentially unlawful private activities, are in fact above the law.

Because this Court finds aspects of such a doctrine repugnant to the nation’s governmental structure and constitutional values, and for reasons further stated below, it ABSTAINS from adjudicating this dispute and DISMISSES the President’s suit.

Following Marrero’s order, the appeals court issued a stay, delaying Mazars’ compliance with the subpoena until it could review the case.

Trump responded to the ruling via Twitter, attacking the subpoena as a political strategy: “The Radical Left Democrats have failed on all fronts, so now they are pushing local New York City and State Democrat prosecutors to go get President Trump.”

The Manhattan district attorney’s office began its probe into Trump’s financial affairs after his former lawyer Michael Cohen was convicted of federal campaign finance law violations connected to payments made to porn actress Stormy Daniels and former Playboy model Karen McDougal to remain silent about alleged affairs with Trump. Cohen is serving a three-year-long prison sentence.

Trump has admitted to ordering the payments, according to prosecutors, but the U.S. Justice Department maintains a policy of not charging the sitting president with crimes.

In recent United States history, it has been customary, but voluntary, for presidential candidates to release their tax returns when running for office. Trump was the first president to refuse to do so since 1976. Trump has cited an Internal Revenue Service audit as prohibiting him from releasing them. The president has a lawsuit to prevent a New York State law from allowing the House of Representatives’ Committee on Ways and Means from gaining access to his records.

Canadian PM cabinet shuffle results

Canadian PM Stephen Harper has shuffled his cabinet today.

The major change with this shuffle is Rona Ambrose, Minister of Environment, being replaced by Treasury Board President John Baird. When a reporter asked her earlier if she would be replaced she replied, “Yes — very excited.” Ambrose is the new intergovernmental affairs minister.

Vic Toews, the justice minister, is now President of the Treasury Board. Rob Nicholson, who was house leader, is now justice minister. Peter Van Loan, who was intergovernmental affairs minister, is now house leader. Monte Solberg, the immigration minister, replaces Diane Finley as Minister of Human Resources and Social Development. Diane Finley, loses the Human Resources portfolio and gets the Citizenship and Immigration ministry.

Six MPs were appointed “Secretary of State” roles, they are junior cabinet ministers. Secretary of States do not make part of the cabinet. These new Secretary of States are :

  • Helena Guergis, MP for Simcoe—Grey, Secretary of State (Foreign Affairs and International Trade) (Sport);
  • Jay Hill, MP for Prince George—Peace River, Secretary of State and Chief Government Whip.
  • Jason Kenney, MP for Calgary Southeast, Secretary of State (Multiculturalism and Canadian Identity);
  • Christian Paradis MP for Mégantic—L’Érable, Secretary of State (Agriculture) and
  • Gerry Ritz, MP for Battlefords—Lloydminster, Secretary of State (Small Business and Tourism);

Marjory LeBreton who was the Leader of the Government in the Senate now also has the role of Secretary of State (Seniors).

The new cabinet still will consist of 27 ministers, 32 if you include the Secretaries.

Viktor Schreckengost dies at 101

Viktor Schreckengost, the father of industrial design and creator of the Jazz Bowl, an iconic piece of Jazz Age art designed for Eleanor Roosevelt during his association with Cowan Pottery died yesterday. He was 101.

Schreckengost was born on June 26, 1906 in Sebring, Ohio, United States.

Schreckengost’s peers included the far more famous designers Raymond Loewy and Norman Bel Geddes.

In 2000, the Cleveland Museum of Art curated the first ever retrospective of Schreckengost’s work. Stunning in scope, the exhibition included sculpture, pottery, dinnerware, drawings, and paintings.

Doctor robbed, car-jacked and locked in boot while car set alight

A 34 year old obstetrician from Forestville on Sydney’s Northern Beaches has escaped after he was robbed, car-jacked and locked in the boot (trunk) of his BMW, which was set alight. Police say the doctor was locked in the boot while his car was set alight, but was allowed to escape before flames engulfed the vehicle.

The Doctor was believed to have been heading to The Mater Hospital in North Sydney when he was waiting at the intersection of West and Falcon Streets in Chatswood around 3:15AM AEDT when a small red sedan with two men claiming to be police officers signalled him to stop. After crossing the intersection, the doctor stopped his car at the side of the road.

The doctor was then approached by the two men and when he asked to see identification, one man grabbed the keys from his car’s ignition before they both pulled the doctor out of his vehicle, hit him in the stomach with a hammer and stole his mobile phone and wallet. The robbers also demanded his key and credit cards along with their access codes before locking him in the boot.

Police allege that the men drove to several locations to withdraw cash and buy things before driving to Carisbook Street in Linley Point at around 4 a.m. local time where they set the car alight with the doctor still in the boot.

Crime Manager of the Harbourside Local Area Command, Detective Inspector Houlahan said that the doctor then “heard a click in the boot area and he heard someone call out: ‘Get out of the car'”

“When he pushed the boot up he found his car engulfed in flames.”

Det. Insp. Houlahan said the doctor told police he did not unlock the boot himself, and it appeared the man’s captors unlocked it before fleeing.

Det Insp Houlahan said that the doctor appeared to be “very distraught” and tired after the ordeal, and wanted to get home and see his wife and two young daughters.

He could only provide police with a vague description of his captors, but said the men were both Caucasian males aged in their 20s, and that one of them was about six feet tall (183cm) with short blond hair and medium build said Det. Insp. Houlahan.

California to require large retailers to have gender-neutral toy sections from 2024

On Saturday, California Governor Gavin Newsom signed into law Assembly Bill 1084 (AB-1084), which requires retailers with 500 or more employees throughout the state to keep a gender-neutral area for childcare products and toys. The law is set to take effect in 2024.

The bill says that “a retail department store that offers childcare items or toys for sale shall maintain a gender neutral section or area, to be labeled at the discretion of the retailer, in which a reasonable selection of the items and toys for children that it sells shall be displayed, regardless of whether they have been traditionally marketed for either girls or for boys.” Boy and girl sections are not prohibited, but a common section alongside them is required. While the original version included clothing, during California Senate proceedings that part was removed from the text.

Non-compliance calls for a US$250 civil penalty for a first case, and US$500 for subsequent violations. Courts could order the violator to pay court costs and attorney’s fees.

Assembly members Evan Low and Cristina Garcia, both members of the Democratic Party, introduced the bill into the California Assembly, the lower house of the state’s legislature. AB-1084 was amended by both houses, then passed the Assembly in a 49-16 vote on September 2 before being sent to the governor’s desk for approval.

Speaking about the bill, Low said, “Part of it is to make sure if you’re a young girl that you can find a police car, fire truck, a periodic table or a dinosaur. And then similarly, if you’re a boy, if you’re more artistic and want to play with glitter, why not? Why should you feel the stigma of saying, ‘Oh, this should be shamed’, and going to a different location?”

On July 25, Garcia noted in a Facebook post, “As a math teacher I saw 1st hand how playtime creates the building blocks for attaining spatial awareness that’s important for studying geometry, unfortunately these toys are often labeled as boy toys. Removing the gender identity from these toys will hopefully lead to more boys & girls entering STEM fields.”

The bill was opposed by members of the Republican Party: Republican state Senator Melissa Melendez said, “I don’t think parents need the government to step in and tell them how they should shop for their children”. In opposition of the bill, the Capitol Resource Institute argued that “it is not the business of the government to instruct retail stores how they should display and market their merchandise.”

On April 6, during a public hearing before the Business and Professions Committee of the Assembly, Greg Burt of the California Family Council called AB-1084 “impossible to comply with” as it does not define the intended meaning of “reasonable amount” and “a bill like this opens the door to a never-ending number of complaints from activist groups who don’t like the way stores are marketing their products to one sex or another”.

Assembly Bill 2826, introduced to the Assembly by Low in 2020, which targeted a similar goal, died in the Legislature.

Retail corporation Target, with 1915 stores in the United States, dropped traditional toy section labeling in 2015. “In fact it would be more difficult to find a large retailer today that segregates toys by gender”, noted the Southwest California Legislative Council, an opponent of the bill.

Kiribati acquires international funding for solar power

Last Tuesday, AusAID Australia and the World Bank’s Global Environment Fund (GEF) reached an agreement to give the government of Kiribati US$5 million (AU$4,779,000, NZ$5,985,000, €3,885,000) to install solar panels around the country capital, located on the Tarawa atoll. According to Business Desk of the Brunei Times, AusAID promised AU$3.2 million in funding, while GEF promised US$1 million. The country was the first in the Pacific to make a deal with the World Bank.

The funding was part of a US$530 million (NZ$635 million) package announced at yesterday’s Pacific Energy Summit in Auckland involving New Zealand and the European Union, Australia, the Asian Development Bank, the European Investment Bank, the Japan International Cooperation Agency, the World Bank Group, and the United Arab Emirates. Also at the summit yesterday, New Zealand’s Foreign Affairs Minister Murray McCully had announced a national commitment of USD$54,262,000 (AU$51,861,000 NZ$65 million, €42,178,000) to Pacific region energy solutions, of which US$8,348,000 (AU$8 million, NZ$10 million, €6,483,000) would be specifically earmarked for renewable energy and improved energy efficiency in the Cook Islands, Kiribati, Papua New Guinea, Samoa, Tonga, and Tuvalu.

Kiribati is heavily dependent on diesel fuel for most of the energy available on the national power grid, which supplies power to half Kiribati’s population of 110,000. In addition, a third of the country’s population lacks access to electricity. Once installation of the solar panels is complete, they are estimated to reduce diesel consumption by 230,000 liters (60,760 gallons) a year and give access to the electricity to some parts of the population that currently have no electricity. The European Union already has committed €100 million to sustainable energy in the region, with €10 million of that coming as a result of an announcement made last week.

In a press release about the news, Kiribati President Anote Tong was quoted as saying, “Kiribati faces big challenges it is remote, it is at risk from the effects of climate change, and it is vulnerable to economic shocks. […] Shifting Kiribati’s focus to reliable solar energy will provide a more secure, more sustainable power source for the country’s people.” Radio New Zealand International quoted Tong as saying, “It’s the first time we are doing this. We’re excited at the prospect of even substituting fossil fuel to a small extent at this stage. What the system being envisaged will only produce around 500 kilowatts, but this is the beginning of what I hope will be a pattern, the trend in the future.”

The European Union’s Fiji-based head of operations for the Pacific region, Renato Mele, supported alternative energy solutions like solar power for the region, but said that solar power had limitations because climate and environmental conditions sometimes meant batteries required to power the panels had a life of only 12 months, compared to other climates where batteries normally last five years. This created the potential to drive up standard operating costs. Mele has also noted these additional costs though are still lower than the cost of diesel power.

One News Pacific Correspondent Barbara Dreaver noted, “Governments will be able to put the money they (currently) spend on diesel into things like education and health.”
